PETA, everyone's favorite group of totally rational animal activists, has launched a new legal attack against SeaWorld this morning, accusing parks in Orlando and California of mistreating five killer whales. Which, actually, OK! There are lots of reasonable arguments against keeping orcas in captivity.PETA's argument, however, is that the killer whales are actually "slaves" whose rights are being violated under the 13th Amendment.

PETA's lawsuit, which they will file in California federal court later this morning, argues that the 13th Amendment -- you know, the one that abolished slavery -- "does not specify that only humans can be victims," the AP reports.

Here's what John Kerr, PETA's legal counsel, has to say about the ... unique argument.

"By any definition, these orcas are slaves -- kidnapped from their homes, kept confined, denied everything that's natural to them and forced to perform tricks for SeaWorld's profit. The males have their sperm collected, the females are artificially inseminated and forced to bear young which are sometimes shipped away."

SeaWorld, meanwhile, is left in the odd position of trying to prove in court that orcas are not people.

"(This suit) is baseless and in many ways offensive," the company says in a statement. "There is no higher priority than the welfare of the animals in our care."

While I agree that orcas should not be kept in captivity and be made to perform, PETA has quite a case ahead of itself to try to prove orcas as being subject to the 13th Amendment. I'd love to see how this transpires.

The PETA organization is bizarre IMO, but rest assured, fellow viner mightyjj and his dory mates catch the best herring an Orca can get at Seaworld.

Well, I for one, find PETA's argument to be absurd. Any sane judge would not only disallow the case (without a hearing), but slap the PETA lawyers with a contempt of court charge. I'm not thrilled with having [relatively] intelligent mammals locked away in aquariums, but to say that they are people is silly.

we know about the other species of life on this planet because of captivity and study....i do not know a great deal about this, but i would assume they are keeping whales that were born in captivity...

either way PETA has made themselves look so idiotic at this point, their involvement in any particular cause is counterproductive...

What about dogs and cats? We make them do tricks and keep them tied up. PETA has gone a bit overboard with this one. They would have to rationalize the release of all animals and beasties kept in captivity to make a real case. Humans breed and keep crickets to feed to snakes and lizards... and don't get me started on ant farms! Hehe. Besides, I think I read something about "All men are created equal...yada, yada" Not all men and squirrels, and whales, and birds...

They would like to take everyone's pets and kill them. That is what they do. They kill animals. They are disinterested in finding homes for animals. Their only agenda is taking away your rights to own, hunt, eat, and breed animals. They have been shot down by some of the greatest champions for animals in the world. The only spokespeople they can get are stupid actors who abuse their spouse and daughter (Alec Baldwin), and many other uneducated famous people. They prey on your stupidity to give based on who they show, not what they do. They create a bunch of videos that are the worst of the worst and prey on your sympathy for donations and then they gather and kill more animals. They are a wolf dressed in sheeps clothing.

Heeere we go again! PETA (People Eating Tasty Animals) are at it again,i.e. seeking publicity. and they do it very well. Unfortunately they have turned themselves into a joke. Maybe its time for all PETA (Please Eat Those Antelope) members to have a sit down chat with the Orcas and discuss the nextmove!

Did anyone from PETA ever ask Tillicum if he felt like a slave? He's the biggest Orca in Orlando - a huge Orca and an awesome sight. He just has to swim around a little, jump up, make a big splash and wiggle his tail and fins to splash the crowd. He sure looks like he's having fun. If he doesn't want to, he won't do it. They feed him pretty good too, lots of fish and an occasional trainer...
